The general conditions of sale contained here will cancel all previous ones. They will be applied to all orders received after the date of issue of this price list. They will also be considered valid for all future deals, even if no specific reference is made for them. They may be subject to change without previous notice and are intended to be integrally accepted with order confirmation.
The prices contained in this price list do not include VAT and may be subject to increase if, during the period between our quotation or the acceptance of an order and delivery, there are increases in price of raw materials, labor costs, transport, insurance fees, etc.
The orders given to our agents or Representatives or sent directly to us by the buyers are final only when duly accepted by our conformation order, which we will regard as being confirmed in all its parts in the absence of an immediate reply on your part.
For orders amounting to a net cost lower than 500 €, the payment terms will, in any case, always be 60 days from the end of the mouth in which the invoice was issued. • The goods are intended ex warehouse from our premises in Pomezia (RM). • Delivery terms are not binding but simply indicative. In any case, the delivery terms are affective only from the moment following the actual conclusion of the sale contract. Nevertheless, delivery terms may be subject to review due to breakdowns and/or unforeseen delays at the factory and/or lack of the supply of the raw materials and/or any other events that cannot be foreseen or controlled by MB PLAST di Melilla Giampiero. The seller has the right to fill in the order with multiple supplies. • Pending parts of orders will be delivered as soon as they are available, unless otherwise instructed by the buyer. • The goods travel at the purchaser’s risk.
All payments must be made to our offices. The acceptance of bills of exchange or our draft do not constitute an exception to the place and/or terms of payment. After expiry of the payment deadlines, bank interest will be applied, according to the official minimum lending rate plus 4%, together with the refund of all extra expenses. For supplies abroad, payments must be made through the opening of an irrevocable letter of credit.
The goods we provide will remain property of MB PLAST srl until the buyer has paid in full. If the buyer sells the goods covered by reserve of property, he immediately, and up to payment in full of what is owed to MB PLAST srl yields all the tights reserved from the sale, including all the additional rights, guarantees and reserves of property.
All technical documents, such as illustrations, graphs, drawings, descriptions, information regarding the physical characteristics, dimensions or weight, as well as all references to regulations, are just an indication and are not binding. MB PLAST srl has the right to make changes to the products, if necessary, even without prior notice, in order to improve them technically.
All complaints concerning the quality and/or the general conditions of the goods must reach us within 15 days from the date of receipt or consignment of the goods, by express post with acknowledgment of receipt or by fax, alter this term, every right will expire. Even in the case of a valid proposed claim, the buyer shall pay the amount stated on the invoice on the date of expiry. Actions against MB PLAST srl cannot be brought forward before having paid in full, even in exceptional cases. Instead, reports of other types of defects shall be made within the respective limits of the pre-established warranty conditions.
No return of goods is accepted if not authorized by us and will, in any case, be carriage free. All returned materials will be accepted only if in good condition and in the original packing.
Our material is guaranteed against faults due to manufacturing defects that are our responsibility. – More than one year has passed since the consignment of the goods. – The material has been in any case modified or tampered with. – All damage due to natural wear, inadequate storage or maintenance, use beyond the conditions we have indicated is not covered by the warranty.
Our warranty is limited to the replacement of defective products or their repair at our premises, with the exclusion of any kind of compensation or recognition of harm caused to people or things due to the use of goods we have supplied, for reasons due to manufacturing defects and/or to the materials used, for hidden defects and for improper use. All controversies or disputes fall under the exclusive jurisdiction of the court of Velletri (Roma). No other condition will be considered valid if not expressly authorized by us.
